03 February 2008. Last year huahinexpat.com has urged foreign residents living in Hua Hin to contact Khun Tuck Dechapanya if they were cheated or unfairly treated. Since last year Khun Tuck has received many requests for help, especially from foreigners. After listening to problem he would contact appropriate government department to investigate the case.

Khun Tuck together with Hua Hin Municipality is working very hard in order to make sure that Hua Hin is a pleasant place to live for everybody. Unfortunately there are foreign individuals who run businesses which cheat their clients.

We post an example of Khun Patricia and Khun Robert Buxton who came to my office (59/52 Soi Hua Na Village Tambol Naongkae, Hua Hin District).

Khun Patricia explained that she has agreed to buy a house and lease the land. The local foreigner Developer selling the house does not want to complete the contract. Khun Patricia has tried many times to see this Developer but he said he has no money even though that Khun Patricia has paid the sum of 9 million Baht. Khun Patricia has shown Khun Tuck all documents and some pictures. Now she is collecting some more documents and “buy & sell" contract as per Thai law and will notify the police.

Another example is from Don Cowell from England. He bought the house and leased the land from the same foreign Developer like Khun Patricia did.

Don Cowell has sent e-mail to Khun Tuck:

' I have been visiting Hua Hin for a number of years and just over one year ago I decided to buy a house in Hua Hin and entered into an agreement to buy a property as detailed in the attached documents. This was a new build project north-west of Hua Hin. At the time that I agreed to buy the property, my villa was already part constructed.
You will see in the main contract document that the property was expected to be completed within six months of the signing of the contracts. Although the contract is dated 12th November 2006, my payment under the contract terms was not received until the 6th December 2006, so I think that contractually that would be deemed to be the commencement date with completion therefore by the 6th June 2007. In addition to the main contract, I also include copies of any documents that relate to any changes to the agreed details.
My main issue is that the property is still not finished and despite countless emails and telephone calls and visits to Hua Hin, I am unable to get any firm commitment from the Developer of when I can expect completion. I have in the past received many statements from him such as “we expect to begin work again on your property soon and once we start it should be complete within 2 to 3 months, although I cannot give you an accurate completion date just now”. On my most recent visit to Hua Hin between the 30th December and the 6th January, I was unable to make any contact with the Developer and since then he has refused to answer any of my calls or emails to him and nobody who works for him is able to give me any answers to my questions."
